§79 Chi è il Fabbricante

A manufacturer can be a natural or legal person, that is to say, an individual or a legal entity such as a company or association. The process of design and construction of machinery or partly completed machinery may involve several individuals or companies, but in this case one of them must take the responsibility, as the manufacturer, for the conformity of the machinery or partly completed machinery with the Directive. However, the term manufacturer in this Directive also can apply to other persons who have the responsibilities for conformity assessment and CE marking – see §81: comments on Article 2 (i).

Since the essential health and safety requirements of the Directive mainly concern the design and construction of machinery, the person who is in the best position to fulfil these requirements is clearly the person who actually designs and constructs the machinery, or who at least controls the design and construction process. In some cases, the manufacturer may design and construct the machinery himself. In other cases, all or part of the design or the construction of the machinery may be carried out by other persons (suppliers or sub-contractors). However, the person who assumes the legal responsibility for the conformity of the machinery or the partly completed machinery with a view to its being placed on the market under his own name or trademark must ensure sufficient control over the work of his suppliers and sub-contractors and possess sufficient information to ensure that he is able to fulfil all his obligations under the Directive as set out in Article 5 – see §105: comments on Article 5 (3).

A person constituting an assembly of machinery is considered as the manufacturer of the assembly – see §38: comments on Article 2 (a). Usually, the elements constituting an assembly of machinery are supplied by different manufacturers, however one person must assume the responsibility for the conformity of the assembly as a whole. This responsibility can be assumed by the manufacturer of one or more of the constituent units, by a contractor or by the user. If a user constitutes an assembly of machinery for his own use he is considered as the manufacturer of the assembly – see §80 below.

Il Fabbricante può essere una persona fisica o giuridica, vale a dire una persona fisica o  una società o un'associazione. Il processo di progettazione e costruzione di macchinari o quasi macchine può coinvolgere più persone o società, ma in questo caso uno di essi deve assumersi la responsabilità, in quanto produttore, della conformità delle macchine o delle macchine parzialmente completate alla Direttiva. Tuttavia, il termine produttore nella presente direttiva può applicarsi anche ad altre persone che hanno la responsabilità della valutazione della conformità e della marcatura CE - vedere §81: commenti sull'articolo 2 (i).

Poiché i requisiti essenziali di salute e sicurezza della Direttiva riguardano principalmente la progettazione e la costruzione di macchinari, la persona che si trova nella posizione migliore per soddisfare tali requisiti è chiaramente la persona che progetta e costruisce effettivamente la macchina o che almeno controlla la progettazione e processo di costruzione. In alcuni casi, il produttore può progettare e costruire lui stesso la macchina. In altri casi, la progettazione o la costruzione della macchina, in tutto o in parte, può essere eseguita da altre persone (fornitori o subappaltatori). Tuttavia, la persona che si assume la responsabilità legale della conformità della macchina o della macchina parzialmente completata in vista della sua immissione sul mercato con il proprio nome o marchio deve garantire un controllo sufficiente sul lavoro dei suoi fornitori e subappaltatori e dispone di informazioni sufficienti per garantire che sia in grado di adempiere a tutti i suoi obblighi ai sensi della direttiva di cui all'articolo 5 - vedere § 105: commenti sull'articolo 5, paragrafo 3.

Una persona che costituisce un gruppo di macchinari è considerata come il produttore del gruppo - vedere §38: commenti sull'articolo 2 (a). Di solito, gli elementi che costituiscono un gruppo di macchinari sono forniti da diversi produttori, tuttavia una persona deve assumersi la responsabilità della conformità del gruppo nel suo insieme. Questa responsabilità può essere assunta dal produttore di una o più unità costitutive, da un appaltatore o dall'utente. Se un utente costituisce un gruppo di macchinari per uso proprio, viene considerato come il produttore del gruppo - vedere §80 di seguito.
